Upper Deck Source of Counterfeit 'YGO' Cards?

In an amended complaint filed December 11th, Konami Digital Entertainment has alleged that Upper Deck is the source of the allegedly counterfeit Yu Gi Oh! TCG cards it found in packages distributed by Vintage Sports Cards (see "Counterfeit Yu Gi Oh! Rares"). In the original complaint, filed in October, Konami named Vintage as the distributor of the packages, but didn't name Upper Deck as a defendant.

In the amended complaint, Konami says, "Plaintiffs recently obtained through discovery documents and testimony from defendant Vintage that identify Upper Deck as the source of the counterfeit 'Rare Cards' being re-packaged and sold by Vintage." The amended complaint adds Upper Deck Company of California and Upper Deck Company of Nevada as additional defendants, in addition to Vintage, in the case.

This information makes clearer the reasons behind Konami's announcement that it was terminating its distribution relationship for the Yu Gi Oh! TCG at around the same time as the amended complaint was filed (see "Konami Takes over YGO TCG").

Upper Deck Denies 'YGO' Counterfeiting Charge

Upper Deck released a statement on Monday calling the allegation in Konami's complaint in the Vintage case that Upper Deck was the source of allegedly counterfeit Yu-Gi-Oh! rare cards distributed by Vintage Sports Cards (see "Upper Deck Source of Counterfeit Yu-Gi-Oh! Cards?") "absurd." Citing its efforts to combat counterfeiting in the past, Upper Deck said, "To think that Upper Deck would be involved in YGO counterfeit activity is therefore not only absurd, it simply does not make sense."

The statement also accused Konami of "unfair and backstabbing tactics" in its efforts toward "removing Upper Deck from the Yu-Gi-Oh! business."

Court Rules in Favor of Upper Deck
 
North Las Vegas, NV (January 26, 2009) — Since December, Konami has twice attempted to convince the courts to issue a restraining order against Upper Deck in Konami's case against Vintage. Both times, the courts have not been persuaded by mere allegations and have denied Konami's motions. To date, California courts have sided with Upper Deck on all rulings. In Europe, Upper Deck International obtained an injunction against Konami, forcing them to honor their contractual commitments there.

On December 11, 2008, following several attempts to negotiate with Konami for the betterment of the Yu-Gi-Oh! Trading Card Game, Upper Deck filed a breech of contract suit against Konami, citing unfair business practices and several instances where Konami had made moves to undermine and ultimately take over the Yu-Gi-Oh! business from Upper Deck. Konami representatives have tried on several occasions to obtain proprietary information from Upper Deck regarding key programs used to support, market and distribute the Yu-Gi-Oh! brand in North America and Europe. Upper Deck has refused to lower itself to the unfair and backstabbing tactics that Konami has used over the past several years toward their ultimate goal of removing Upper Deck from the Yu-Gi-Oh! business.


The day following Upper Deck's suit, Konami added Upper Deck as a defendant in its three month-old lawsuit against Vintage, an absurd allegation with dubious timing considering Upper Deck's history of fighting Yu-Gi-Oh! counterfeit cards over the last six years.


Since the start of the Yu-Gi-Oh! distribution in the USA and Europe, Upper Deck and the Yu-Gi-Oh! consortium (Shueisha, ADK, TV Tokyo and Sensei Takahashi) have suffered irrevocable harm by Konami's unwillingness to give Upper Deck legal support in fighting against the manufacture and importation of billions of counterfeit Yu-Gi-oh! cards. Upper Deck has spent millions of dollars fighting against Yu-Gi-Oh! counterfeits and even raided Chinese factories itself because Konami refused to do so or, in some cases, simply reacted too late.


To think that Upper Deck would be involved in YGO counterfeit activity is therefore not only absurd, it simply does not make sense.


Upper Deck estimates that Yu-Gi-Oh! counterfeit activity since 2003 has resulted in damages to the company of several hundreds of millions of dollars in the European and North American territories.

Upper Deck International and The Upper Deck Company clarification

One of the assumptions being made by several media and consumers is that Upper Deck International (UDI) and The Upper Deck Company (UDC) are one and the same company. This is however not the case. UDI has no legal, fiscal, management and/or financial ties to UDC. UDI is not a subsidiary or a sister company of UDC, but a total separate organization. Even though some licenses and practices are shared, UDI operates on a total different level having its own mission statement and vision. For example UDI's focus is sole entertainment business, being preliminary toys, puzzles and games, amongst which trading card games, whereas UDC business is preliminary sports collectibles.

 

As the UDI head office is situated in The Netherlands, the recent injunction against Konami was filed in a Dutch court. UDI has a separate agreement with Konami, acting as the exclusive
Yu-Gi-Oh!™ distributor in various international territories. Primarily Konami brought in that UDC and UDI are one and the same company as the main reason for the termination of the UDI agreement, however evidence proved different and therefore the judge denied Konami's reasoning for terminating the agreement with Upper Deck International BV.

 

Following the successful outcome of the injunction against Konami, in which the Dutch court decided in favor Upper Deck International BV, we have announced that UDI launches expansions and events as planned across all territories (where applicable) that UDI is currently distributing the Yu-Gi-Oh!™ TCG: Europe, Middle East, Africa, Latin America and Oceania.

Konami Digital Entertainment, Inc. (KDE) is putting the final touches on the company's plans to launch nationally its Yu-Gi-Oh! TRADING CARD GAME (TCG) sneak peek events beginning with the soon-to-be released Crimson Crisis booster set. Crimson Crisis (MSRP $3.99 per nine-card pack) will be released at local hobby stores participating in KDE's sneak peek extravaganza on February 28 and March 1, depending on the stores' preference. The Crimson Crisis booster set will be available nationwide at those hobby stores not participating in the sneak peek event and retailers on March 3.

Duelists won't have to look around to find the best deal in town; they just need to head to their favorite hobby gaming store for Yu-Gi-Oh! TCG sneak peek events. We are offering kits featuring Crimson Crisis to all hobby store owners who would like to host a sneak peek.

Yu-Gi-Oh! TCG Sneak Peeks to be Held at Hobby Stores

El Segundo, CA – (January 21, 2009) – Looking to build lasting relationships with hobby stores nationally, Konami Digital Entertainment, Inc. (KDE) has put in motion a plan to hold Yu-Gi-Oh! TRADING CARD GAME sneak peek events beginning with the soon-to-be released Crimson Crisis booster set. Crimson Crisis (MSRP $3.99 per nine-card pack) will first be released at hobby stores participating in KDE's sneak peek extravaganza on either February 28 or March 1, depending on the store's preference. Following the successful outcome of the injunction against Konami, in which the Dutch court decided in favor of Upper Deck Panoceanic CV and Upper Deck International BV, we are pleased to announce that UDI launches expansions and events as planned. This means that the following expansions will be released:

 

Duelist Pack – Yusei (DP8):  February 24th, 2009 
Crimson Crisis Booster:  March 3rd, 2009

 

As with all new booster releases we scheduled a sneak preview for Crimson Crisis. This event will be held on February 28th and March 1st.

North Las Vegas, NV (January 16, 2009) — Upper Deck regrets to announce that the Yu-Gi-Oh! community will be denied yet another product, as Konami Digital Entertainment has failed to deliver Crimson Crisis to Upper Deck, despite contractual obligations.  Crimson Crisis was scheduled to debut at Sneak Preview events throughout North America on February 7 – 8, 2009. 


Upper Deck continues to focus on the best interests of Duelists, and recently announced Upper Deck Day, a multi-brand event that will be hosted at former Sneak Preview locations on the same weekend.  Upper Deck Day will offer high-level Dueling, ensuring that players do not have to miss out on the game they love.  The special "Duelist Challenge" event will feature amazing prizes, including a Gold Sarcophagus to the winner at each location!  VisitUDE.com to find an event near you!

Comentarios y preguntas que le hicimos a Alejandro despues de la noticia:


1.- Ahora que has ganado Regionales, un Nacional, ya fuiste al Mundial has ido a varios ShonenJump y has ganado uno que crees que siga?

Realmente no sé que siga, espero tener tiempo para seguir jugando dado que la escuela la tomaré como prioridad, pero por el momento me siento satisfecho por haber "limpiado" un poco de lo que pasó en el mundial.


2.- Ganar un Shonen Jump no tiene precio pero cuanto cuesta la entrada a un Shonen Jump?

20 Dlls.


3.- Que Premios te dieron y cual te gusto más?

Una lap top, un doomcaliber knight, 24 boosters de crossroads y el trofeo; mmm yo diría que el trofeo es el que me gusta más realmente:S jeje, me hubiera gustado un trofeo en el nacional Pícaro.


4.- Que deck llevaste y que carta fue la que mas te ayudo?

Dark Synchro, la carta que me ayudó más fue brain control, en la última ronda mi oponente tenía muy poca vida e íbamos 1-0 a mi favor, él sólo tenía un colossal fighter, yo tenía un armageddon knight y necro gardna en mano, y robé BRAIN CONTROL!!! jaja, el tipo se sintió mal pero pues ni modo este juego es de suerte; y en la final según el feature match no juntaba los puntos de vida para ganarle pero lo que pasa esque no vieron el brain control, en cuanto lo vió César recogió y me cedió el match. Cuando jugué contra lightsworn en ambos juegos el brain control fue la carta que cambió el juego.


5.- Juegas todo tipo de eventos de yugi pero cual te gusta mas?

Pues el nacional y el mundial porque sólo se dan una vez al año, y los locales también porque juego con amigos y conocidos.


6.- Algo que quieras decir en General a la comunidad de yugi?

Agradecer a todos, dado que en este juego he conocido buenos amigos y una forma de pasar bien el tiempo.


Cabe señalar que Alejandro tambien es el Mexicano con mayor puntaje en el Ranking Nacional y esperamos tenga cada vez mas competencia y ver mas duelistas mexicanos sobresalir, saludos.

Konami Fails to Release Product

 

 

North Las Vegas, NV (January 13, 2009) — Upper Deck regrets to announce that hobby tournament stores nationwide will not receive their orders of Yu-Gi-Oh! TRADING CARD GAME Champion Packs.  Despite contractual obligations, Konami Digital Entertainment failed to send the Yu-Gi-Oh! TCG Champion Packs to Upper Deck for distribution to hobby stores.

 

Keeping the best interests of Yu-Gi-Oh! players and retailers in mind, Upper Deck has maintained business as usual during this uncertain time, fulfilling orders and shipping product to retailers so that Duelists can continue to enjoy the game.  Unfortunately, Konami Digital has not released the Yu-Gi-Oh! TCG Champion Packs to Upper Deck, despite having received the order on time several months ago, rendering Upper Deck unable to fill orders from hobby stores. 

 

Upper Deck regrets that the Yu-Gi-Oh! community is being denied this product, but encourages players to continue to support their local hobby store. Please stay tuned to UDE.com for information about upcoming events.
